Warpgate Software License Terms
Effective date: July 5, 2026
These Warpgate Software License Terms (the “License Terms”) govern the Warpgate Software. They are incorporated into the Mezusphere Terms of Service (the “Customer Terms”) and apply whenever you download, install, copy, run, access, or use the Warpgate Software. Capitalized terms not defined here have the meanings given in the Customer Terms.
By downloading, installing, copying, running, or using the Warpgate Software, you agree to these License Terms.
1. Warpgate Software
“Warpgate Software” means Mezusphere’s customer-deployed connector software, including binaries, container images, sidecar and Kubernetes deployment artifacts, command-line interfaces, installation scripts, updates, patches, configuration examples, documentation, and related components made available by Mezusphere for use with the Mezusphere service.
The Warpgate Software is licensed, not sold.
2. License grant
Subject to the Customer Terms, any applicable Order, and these License Terms, Mezusphere grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license during your subscription or pilot term to download, install, copy internally as reasonably necessary, run, and use the Warpgate Software in environments you control, solely in connection with your authorized use of the Mezusphere service. Your Authorized Users, including contractors operating environments on your behalf, may exercise this license for you.
3. Restrictions
You must not, and must not permit any third party to:
- reverse engineer, decompile, or disassemble the Warpgate Software, except to the extent this restriction is prohibited by mandatory law;
- modify the Warpgate Software or create derivative works of it;
- bypass or disable license, usage, security, or access controls;
- use the Warpgate Software other than with the Mezusphere service, or host it as a standalone service for third parties;
- sublicense, sell, rent, or redistribute the Warpgate Software outside your organization;
- publish benchmarks of the Warpgate Software or the Service without our prior written permission;
- remove or alter proprietary notices;
- use the Warpgate Software to attack, probe, or gain unauthorized access to Mezusphere, other Mezusphere customers, or third parties, or to extract credentials or secrets not issued to you; or
- use the Warpgate Software after your right to use it ends.
4. Your environment
The Warpgate Software runs inside infrastructure you control. You are responsible for the Customer Environment in which it is installed or operated, including hosts, containers, clusters, networks, upstream workloads, identity providers, credentials, API keys, secrets, configuration, and local logs. This includes securing the host and orchestration platform, applying least privilege, protecting and rotating Warpgate service credentials, keeping the Warpgate Software reasonably up to date, and controlling who may install and operate it.
5. Updates and version support
Mezusphere may release updates and security patches for the Warpgate Software and may publish supported version ranges. Outdated versions may lose compatibility with the Service, and Mezusphere may restrict connections from versions with known critical vulnerabilities, with reasonable notice where practicable and immediately where required to protect the platform or customers.
6. Operational data
The Warpgate Software sends operational data necessary to establish, authenticate, maintain, secure, and troubleshoot its connection to Mezusphere, such as connection and session status, authentication data, version information, error diagnostics, and security events. The Warpgate Software does not send general host telemetry, source code, file-system contents, environment variables, or application secrets to Mezusphere, except where you explicitly configure such data to be transmitted through the Service or provide it to Mezusphere for support. Customer traffic that you route through the Service is processed as described in the Customer Terms.
7. Open-source components
The Warpgate Software includes third-party and open-source components that remain subject to their own license terms. Notices are shipped with the Warpgate Software and are available through its distribution artifacts. Nothing in these License Terms limits your rights under those third-party licenses.
8. Ownership and feedback
Mezusphere and its licensors retain all intellectual property rights in the Warpgate Software. You receive only the rights expressly granted in Section 2. Feedback you provide about the Warpgate Software may be used by Mezusphere without restriction or obligation, provided we do not disclose your confidential information.
9. Export controls
The Warpgate Software may be subject to export control and sanctions laws, including those of Japan. You must not export, re-export, or provide the Warpgate Software in violation of those laws, and you must not use it for prohibited weapons-related end uses or provide it to sanctioned or denied parties.
10. Term and termination
These License Terms apply for as long as you use the Warpgate Software. The license terminates automatically when the Customer Terms or your subscription or pilot term ends, or immediately on notice if you materially breach these License Terms. Upon termination you must stop using the Warpgate Software, remove it from your environments, delete or destroy copies in your possession, and revoke or delete associated service credentials and cached secrets. On reasonable request in enterprise or security-sensitive cases, you will confirm deletion in writing.
11. Warranty disclaimer
The Warpgate Software is provided “as is” and “as available”. Mezusphere disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, and does not warrant uninterrupted or error-free operation, compatibility with every environment, or that the Warpgate Software will secure your workloads or environments.
12. Liability
Liability arising out of or relating to the Warpgate Software is governed by the limitation of liability in the Customer Terms. These License Terms do not create a separate or additional liability cap.
13. Order of precedence
For subject matter specific to the Warpgate Software, these License Terms control over the Customer Terms. For all other matters, the Customer Terms control.
14. Language
These License Terms are provided in English and Japanese. In case of inconsistency, the English version controls, except where mandatory law provides otherwise.
